Will I able to talk in front of the judge to explain why I want to drop charges?
Hi,
Tomorrow I have to go to court as a victim of domestic violence. I want to ask the prosecutor to drop the charges as all he did was bruise my arm when he pushed me away from the door of my apartment.
So will I be able to explain myself? Because I really would like the judge and my ex to hear what I have to say.

Yes you will be able to explain yourself. The judge needs to hear the truth from each side in any case that is before him or her. It may be a little different when it’s a criminal case against your ex than when it’s a civil case under the domestic violence protection (relief from abuse) statute. In criminal cases you need to talk with the prosecutor first. Let him or her know how you feel about the case. But in criminal cases you are not the party. It’s the State against your ex. Your role is as a witness. If you are called upon to testify you will be sworn to tell the truth. You will need to answer questions under oath unless the answers are privileged or protected under your own fifth amendment rights against self incrimination. It sounds like you could benefit from a discussion with a private lawyer, victim’s advocate or counselor to help you focus on what happened, why it happened, and to help you determine your objectives.
